Terms of sale

Applicability.

The general conditions of purchase and use are intended to regulate the provision of information as well as business transactions which may arise between AIR FREN and domain users. The navigation and the acquisition of anyone of the products offered suppose the acceptance as user, without reservations of any class, of the present  conditions. AIR FREN may, at any time and without notice, change the general conditions of use and sale and the individual conditions which will be included by posting such changes in the website, in order that they may be known by users.

The products presented on the website are in compliance with the Spanish legislation. AIR FREN responsibility cannot be invoked in case of non-conforming products with the laws of the countries where they have been shipped according to the order of the customer. Therefore, corresponds to the customers to verify the possibility of importing or using the products they request.

Prices.

The indicated prices are net, they exclude any right or rate tax, which will be later passed on to the invoice with the corresponding tax rates, as well as any expenses related to the sale of the goods and its delivery. Prices do not include transport costs, which will always be billed as a separate concept. Prices may be modified at any time by AIR FREN with written notification to the client.

Regarding Orders.

To place an order you should connect and register as user by completing the electronic form displayed in the Store and following the instructions. During the purchasing process, you must add the product you wish to purchase to the basket, according to particulars on the screen, filling the supply form and validating it.

The validation of the order by the client means the knowledge and acceptance of these Conditions as part of the celebration of the contract. Unless opposite proof, the data recorded by AIR FREN constitute the proof of all transactions between AIR FREN and their customers. AIR FREN will file the electronic document in which the contract is executed and it will be accessible.

Once the purchase and in the shortest time, always before 24 hours after the execution of the purchase, the sales department of AIR FREN will send the proof of purchase by email. If you disagree with data provided in the confirmation you may request the amendment or cancellation of the contract.

In case there is any inventory shortage or unavailability of an item, AIR FREN will contact with the customer to notify it immediately and give him a new delivery date or, if it is not possible to serve the product, to proceed to the cancellation. In any case, a delay in delivery deadlines indicated not entitle the customer to demand for a compensation.

Products are shipped to the shipping address that user has specified in the order. In exceptional cases, AIR FREN reserve the right to break down the order, sending the items available and leaving open a second shipping with items not available. AIR FREN will contact with the customer and will agree another delivery date or the partial delivery of the order. The customer agrees to allow the delivery of the order by providing a delivery address where it can be delivered within the normal delivery time. In case of default by the client this obligation, AIR FREN shall have no liability for delays or impossibility of delivery of the order.

Delivery conditions.

Shipping costs and/or management are not included in the price and will be shown during the purchase, once the delivery address has been indicated or after registering as user in our online store. Shipping costs vary depending on the delivery address of each order, the price of the purchased products and the weight of the sum of the products in each order.

Methods of shipment:

1.- Shipping to Peninsular Spain. Orders are sent by SEUR 24, standard service. In some cases, and always at the discretion of AIR FREN, the client will have the following options:

- SEUR 24, standard service, with delivery throughout the working day following collection.

- Service DHL Domestic Economy, with delivery throughout the working day following collection (to consider exceptions for remote areas).

- The customer can choose to send the transport agency to collect the merchandise. In this case, costs of carriage will be borne by him (costs incurred in collecting and delivering and any other associated shipping costs. Ex: taxes).

2.- Shipping to Baleares. Orders are sent by SEUR Baleares. In some cases, and always at the discretion of AIR FREN, the customer shall have the following options:

-SEUR Baleares, with delivery within 1-2 business days (excluding Ibiza Menorca within 2-3 business days). 

-Service DHL Domestic Economy, with delivery within 2-3 working days.

-The customer can choose to send the transport agency to collect the merchandise. In this case, costs of carriage will be borne by him (costs incurred in collecting and delivering and any other associated shipping costs. Ex: taxes).

3.- Shipping to Canarias: Orders are shipped by SEUR Canarias. In some cases, and always at the discretion of AIR FREN, the customer shall have the following options:

- Aéreo Seur Canarias, for any shipment for the Canary Islands and within 2-3 working days after collection.

-The customer can choose to send the transit agency to collect the merchandise. In this case, costs of carriage will be borne by him (costs incurred in collecting and delivering and any other associated shipping costs. Ex: taxes).

4.- Shipping to the rest of the world. International Shipments (to countries other than Portugal): TNT Economy Express Service. Making purchases on a business day, the delivery time depends on the country of destination. International shipments to certain destinations may involve certain difficulties or blockages in the customs of the respective countries. In these cases, the delivery time indicated by TNT website do not include the blocking time in customs. AIR FREN will inform as much as possible of the situation of the order but will not be responsible for it. Any fees in the customs office in the destination country will be assume by the customer.

If, for any reason, we could not make the shipment to the destination that the customer asks us, we will refund the total amount of the order or would offer the possibility of do it by any other transport company on the costs billed by this company.

Payment and refund methods.

AIR FREN proposes different methods of payment so customer can choose the best for him.

Payment by Credit Card: You can use Debit / Credit VISA and MasterCard. The charge on your card will be made immediately and will be in this moment when the purchase is understood. In the event that the TPV report the denial of the card, we will automatically cancel the order, informing the customer by the cancellation.

Transfer: By placing your order, you will receive an email with our bank account. Transfer the money to the account specified in the email, with your name, surname and order number (which we provided) on the concept of the transfer.

This method of payment is not immediate. If your bank is in Spanish territory usually takes from 1 to 2 business days to receive the transfer, so we cannot understand the sale until the amount of the price is available in AIR FREN bank account. It is at this time when we proceed to send your order.

Payment by Paypal: You can use your Personal PayPal Account or other methods (debit and credit cards) through PayPal. It is an immediate method of payment so that the shopping can be understood also immediate and the shipment will be processed on the same way.

Other forms of payment agreed by AIR FREN: Method only available for some customers and in any case in compliance with Law 15/2010 of 5 July, amending Law 3/2004 of December 29. You cannot access this type of conditions without the prior agreement and consent of AIR FREN.

About the refund procedure, it is always through the same payment method used in the purchase.

Terms and conditions of guarantee and refund.

Air Fren grants in relation to its products a guarantee of 12 months. This guarantee is in addition to the legally and without prejudice to the mandatory legal rules on liability.

The guarantee shall cover those defects occurred during the guarantee period, with the exception of defects expressly excluded by this Terms and Conditions of Guarantee.

The guarantee period shall start on the purchase date, paying attention to the delivery note date.

In case of acceptance of the guarantee and unless otherwise indicated by the customer, AIR FREN shall provide a unit of the same reference, new and free of charge. In the event of not being able to serve the similar unit, AIR FREN will refund to the customer the value of the piece, taking as reference the price paid for the defective part in the invoice. In the same way we will proceed if the client explicitly transmits to us their willingness to receive the refund of the part for the specific case. Anyway, the part covered by guarantee shall become property of AIR FREN.

In any case the guarantee includes the right to repair the part provided or the refund of costs incurred for repairing it, nor the payment of any damages or expenses.

In case of denied guarantee, AIR FREN shall return the part to the customer with his next order and, in any case, shipping costs will be a customer responsibility. If the customer expressly transmits, he does not want the piece, then he will lose the rights to it and the part will be destroyed.

Any part sent for guarantee must include the application form and the required information. This form can be found on our website or requested to our quality department. Also, all returns will be freight prepaid, this is the responsibility of the customer. If the guarantee is accepted AIR FREN will proceed to the payment of carriage charges according to the market current price.

There shall be no acceptance of the guarantee when the deterioration of the part is due to:

1. Inadequate or no due diligence handling.

2. The part has been dismantled, with a part replaced or with original features modified.

3. A natural wear.

4. Inadequate maintenance.

5. Natural or environmental agents.

Nor guarantee will proceed on those parts that control plate is removed or the part has been marked.

The customer has a period of 15 days from the date of the receipt of the item to notify AIR FREN his intention to return it and also the justification. Should AIR FREN accepts the return, the customer will send the item by courier to our address, taking charge of the expenses of transportation.

 About the refund procedure, it is always through the means of payment used in the purchase.

Applicable legislation.

Any commercial transaction between AIR FREN and the customer shall be governed by the Spanish legislation, which will apply in all matters related to the interpretation, validity and implementation of these Sale Conditions.

The parties expressly resign any other jurisdiction that might correspond to them and are subject to the jurisdiction of the Courts of Zaragoza to resolve any dispute that arise in the interpretation or implementation of these Conditions.
